Lagos East: Appeal Court Dismisses PDP s Suit Against APC s Abiru – Channels Television

Credit: @TokunboAbiru   The Court of Appeal sitting in Lagos has dismissed a suit filed by the Peoples Democratic Party (PDP) seeking to disqualify Senator Adetokunbo Abiru of the All Progressives Congress (APC) from continuing to represent Lagos East Senatorial District. In a judgment delivered on Thursday via zoom, a three-man panel of the court affirmed the March 1 decision of the Federal High Court in Lagos which dismissed Babatunde Gbadamosi and the PDP’s suit for lacking in merit.

TODAY March 2, 2021 A Federal High Court sitting in Ikoyi, Lagos, has struck out the new facts sought by Peoples Democratic Party, PDP, and Mr Babatunde Olalere Gbadamosi, challenging the indigeneship of the All Progressives Congress, APC, candidate, Senator Tokunbo Abiru, in the recently conducted Lagos East Senatorial District poll. In delivering its judgment, the court first dealt with the notice of preliminary objection filed by Kemi Pinheiro (SAN) on behalf of the 2nd Defendant (Senator Adetokunbo Abiru). The Court agreed with his contention that part of the reliefs sought by the Plaintiffs was statute-barred having not been brought within 14days of the accrual of the cause of action as contemplated under Section 285 of the constitution, consequently, reliefs 2,3, 4, 5,10 and 11 were struck out.

Judge withdraws from suit against Air Peace, NCAA, others

The suit filed against Air Peace Limited, Inspector-General of Police (IGP), the Nigerian Civil Aviation Authority (NCAA) and others over alleged right abuse has suffered set back, following the withdrawal of the trial judge, Justice Chuka Austine Obiozor from hearing it.
