Environment Minister slammed for ‘embarrassing’ appeal decision Environment Minister slammed for ‘embarrassing’ appeal decision 13 July 2021 • By Naomi Neilson Share Teenagers behind a landmark Federal Court ruling have criticised the Environment Minister and the Morrison government for the “embarrassing” decision to appeal against having a duty of care to protect young Australians from potential harm. Earlier this week, the Federal Court ruled in favour of eight young Australians who argued that the government must protect them from foreseeable future harms of climate change, particularly the “catastrophic” damage that could be done if projects that contribute to an increase in the earth’s temperature are permitted to proceed.

Back in 2002 the then-treasurer, Peter Costello, had a problem. Environment minister to challenge court ruling that she owes children a duty of care over climate change

Share on Twitter Environment Minister Sussan Ley is appealing a Federal Court declaration that she has a duty of care to protect children from future personal injury caused by climate change. Justice Mordecai Bromberg made official on Thursday his ruling that Ms Ley owed the duty to all Australian children when exercising her legislative decision-making powers, regarding the Vickery Coal Mine in northern NSW. Eight children took action against Ms Ley last year, challenging an expansion to the Whitehaven Coal-owned project north of Gunnedah.
