Shifting N C Supreme Court lineup could have impact on campus transparency - Carolina Journal

With the U.S. Supreme Court shutting the door this month on future legal action, a state Supreme Court decision will continue to dictate the University of North Carolina’s compliance with public records requests linked to sexual assaults. Now is a good time to review the issue. Membership on the N.C. Supreme Court has changed since justices split, 4-3, on the topic last spring. The dispute dates back more than four years. In September 2016, media organizations including the student-run Daily Tar Heel issued a request to the University of North Carolina at Chapel Hill. The media wanted copies of records of all students found responsible through campus agencies for rape, sexual assault, or other related misconduct. Within a month, the university denied the request.

Appeals Court Judge Hunter Murphy censured for condoning workplace harassment by friend-turned-aide

(Photo: Judge J. Hunter Murphy, North Carolina Judicial Branch) The Supreme Court of North Carolina ordered the censure of Appeals Court Judge Hunter Murphy for enabling a “toxic work environment” in his chamber, in a disciplinary order reaffirming the Judicial Standards Commission recommendation Friday. The ruling was unanimous, with the exception of Justice Mark Davis, who did not take part in consideration of the matter. Murphy, a Republican, hired his high school friend Ben Tuite as his executive assistant, the senior position on his three-person law clerk staff, after being elected in 2016. It wasn’t before long that Tuite started bullying and harassing his coworkers, exhibiting a “pattern of making lewd or sexually inappropriate remarks in the workplace,” according to the court order.

Newby s Narrow Win Suggests Broader Philosophical Changes in N C Courts

Publisher s Note: This post appears here courtesy of the Carolina Journal. The author of this post is Rick Henderson.     It took five weeks to settle the final race, but when the N.C. Supreme Court s session opens in a few weeks, there will be a new chief in Raleigh.     Republican Associate Justice Paul Newby defeated incumbent Democratic Chief Justice Cheri Beasley by roughly 400 votes. Nearly 5.4 million ballots were cast. Beasley, who was elevated to the court s top spot by Gov. Roy Cooper in 2019, conceded to Newby on Dec. 12 after a hand recount of sample precincts statewide suggested she wouldn t prevail if all the ballots were counted by hand.
