In a significant verdict, the Supreme Court in the case Bilkis Yakub Rasool v. Union of India (“Bilkis Bano Case”), has quashed the order of the Gujarat Government granting remission to the 11.
The Court ruled that the appropriate government entitled to pass order of remission of convicts was Maharashtra government and not Gujarat since the trial in the case had happened in Maharashtra.
The Court said the Gujarat government should have filed a review petition against the Supreme Court judgment that declared it to be competent to decide the plea for remission of convicts in the case.
