While the Warners are set to be released from prison, there are stipulations they must follow in order to stay on bond. Per court records, the Warners must post $100,000 each as bond; this can be either $100,000 cash, or through a bondsmen which acts as surety and pledges money to cover the bond.
The Court of Appeals also placed requirements for bond that do not allow the Warners to operate a vehicle, or consume alcohol or illegal drugs. Additionally, the Warners must follow other pretrial and non-financial conditions, which includes not making contact with the victim, Colton Gray, or his family.

Marion Judge Jason Warner seeks release from prison during appeal
Twelve days after being sentenced to two years in prison, Marion Judge Jason Warner has asked to be released pending an appeal of his conviction.
According to online court records, Warner filed a motion on April 26 signaling to the court he will appeal the sentencing from visiting Judge Patricia Cosgrove, former Summit County Common Pleas Judge who was appointed for this trial after retiring in 2011.
Previously on April 14, Jason Warner and his wife, Julia, were both found guilty on one count each of complicity to tampering with evidence, a third-degree felony; and complicity in failure to stop after an accident, a fourth-degree felony. They received a concurrent two-year prison sentence for these felonies. According to the Department of Rehabilitation and Correction, they are expected to be released on April 8, 2023, but they can apply for judicial release after six months.

When Marion County Judge Jason Warner s role in the hit-skip crash from last June became public, many residents questioned whether the justice system could hold one of their own accountable.
Online comments asserted that Warner and his wife, Julia, would get special treatment because of his position. A local judge would be treated better than a regular Joe or Jane.
The resulting photos of Jason Warner being led away in handcuffs on Wednesday should have put such concerns to rest.
Yes, the justice system can often be excruciatingly slow, but in this case it showed that it can work to ensure people in power are not given special treatment.
