On May 14, Twitter filed a notice of appeal with the Ninth Circuit following a decision rendered by a San Francisco, Calif. judge in favor of Texas Attorney General Ken Paxton. The case concerns Twitter’s constitutional challenge to an investigation Paxton allegedly initiated to punish the message sharing platform for its content moderation decisions made in the wake of the deadly attack on the U.S. Capitol this January.
Twitter sought to halt the allegedly retailatory investigation, but was told its suit was premature in last week’s ruling by Judge Maxine M. Chesney. The opinion and order granted Paxton’s motion to dismiss, which according to the plaintiff-appellant, effectively denied its motion for a preliminary injunction.
A California federal judge dismissed an amended suit brought by a spouse looking to hold her husband's employer responsible for her COVID-19 infection, finding that the state's workers' compensation law bars her argument and further noting that the employer's duty to provide a safe work environment does not extend to non-employees.

The Northern District of California court presiding over Twitter Inc.âs lawsuit against Texas Attorney General Ken Paxton dismissed the case for want of subject matter jurisdiction on Tuesday. The lawsuit sought to halt Paxtonâs investigation into Twitterâs content moderation practices following the suspension of accounts linked to the January attack on the U.S. Capitol.
As previously reported, the online message sharing platform suspended and restricted numerous accounts for violations of its content policies in the aftermath of the Capitol riot. Then-President Donald Trumpâs account was among those suspended for purportedly glorifying or inciting violence and manipulating or interfering with civil processes.

The ruling turned on a technicality and the court did not address the merits of Twitter’s claim, finding that the court lacked subject matter jurisdiction over the case because the company’s claims were prematurely filed.
