Drug driving prosecution dismissed after Leitrim judge has doubt about statutory requirement

A case of alleged drug driving was dismissed after the judge said he had a doubt that the arresting garda had made a statutory requirement for the defendant to remain at the scene until a roadside testing apparatus arrived.
Appearing before Carrick-on-Shannon District Court last week was Leigh Langan McManus, 6 Rockingham, Carrick-on-Shannon, Co Leitrim charged with the alleged offence at Doon, Boyle, Co Roscommon on at 7.50pm on April 20, 2019.
Mr McManus was stopped by Garda Aisling O’Brien travelling at 85 in a 50kph zone. He told the garda he was travelling back to work in Carrick-on-Shannon and was late.
Leitrim Judge dissatisfied with evidence in drunk driving case

“There s an X factor in this case that I can t put my finger on but I m not happy about it. There s something else going on but I don t know what it is,” said Judge Kevin Kilrane before dismissing charges of alleged drunk driving and careless driving in Carrick-on-Shannon District Court last week.
The case involved Justin McBride, Clogher Grange, Carrick-on-Shannon, Co Leitrim who was charged with driving with excess alcohol in his breath and careless driving on July 22, 2019 at Grange, Carrick-on-Shannon.
Garda Paul Mannion said he was on patrol at 2.19am on the above date with Gardai Currid and McHale. They were in the garda van travelling into Carrick-on-Shannon from the Longford direction.

A man who has “an appalling record” and who was four times the legal limit was convicted and fined a total of €1,000 and disqualified from driving for three years at Carrick-on-Shannon District Court last week.
John Harte, Shragh, Cloonloo, Boyle, Co Roscommon was charged with careless driving and hit and run of a vehicle belonging to Declan Regan at Tinacarra, Boyle on November 23, 2019, and with being drunk in charge of a vehicle with intent to drive at Elphin St, Boyle on the same date.
