Last spring, a judge granted a new trial for an Elkhart man who says police exploited his mental disability and pressured him into falsely confessing to killing a woman in 2002.
Special Judge Joe Sutton, of Kosciusko County, ruled in favor of Andrew Royer at the time, finding that multiple points â including the claim that the Elkhart police detective who interrogated Royer knew about and disregarded Royerâs disability; that the detective fed Royer details of the murder during the interrogation; and that the detective had been removed from the Elkhart homicide unit prior to Royerâs trial in 2005 â constituted newly discovered evidence in the case.
