cream wars are really heating up. the owner of one ice cream truck believes the city isn t big enough for two. lindsay neilson has all of the details. reporter: that friendly sound of an ice cream truck turned mean on the streets of gloversville. police say starting an ice cream war. it is a rather unique situation. reporter: police say the gloversville, mr. dingaling would greet customers and then came aggressively loud music of snowcone joe. police say the operators of snowcone joe, 34-year-old josh malatino, and his girlfriend, 21-year-old amanda scott, were talking mr. dingaling on several different occasions on multiple city streets. one of our officers actually witnessed one of the ice cream trucks following the other ice cream truck. reporter: police say an attempt to steal away customers from mr. dingaling, malatino and scott shouted that snowcone joe ice cream was free. he had two vehicles, two ice
cream trucks they were both engaged in the conduct. reporter: i called josh malatino. when asked about the incidents, he said his girlfriend was the owner and that his attorney could answer my questions, but calls to his attorney were not returned. police say last summer malatino was warned for using similar tactics. we have addressed issues similar to this with mr. malatino and his legal counsel, cautioning him against this type of behavior in the past. can you believe that one? i cannot believe that one. mr. dingaling, poor guy. snowcone joe. the names alone are great. officers charge the operator of snowcone joe, malatino and scott, with harassment and misdemeanor stalking. if convicted, they could spend up to three months in jail. stay away from mr. dingaling from now on. three months on ice. very nicely put. lindsay neilson from our station. houston, we have a problem. classic movie line, right?
