An activist arrested on Tuesday over a poster of President Uhuru Kenyatta widely circulated online will today know how long he will continue to be in custody as police prepare charges against him.
Senior Resident Magistrate Jane Kamau yesterday ordered police to detain Edwin Mutemi Kiama at Central Police Station and present him in court today for the ruling.
Police had sought to detain the suspect for 14 days as they complete their investigations, but this was opposed by Kiama s lawyers Haroun Ndubi and Martha Karua.

Court declines request to drop Babu Owino’s attempted murder case

Summary
The victim, Felix Orinda popularly known as DJ Evolve, wanted to withdraw the criminal case on grounds he and the lawmaker were good friends even before the January 2020 shooting incident that resulted to the court trial.
Through a letter dated September 21, 2020 addressed to the Director of Public Prosecutions (DPP) and the Court’s Executive Officer, the victim and his family indicated that the court case was affecting his healing process due to a divided attention.
But the court presided by senior principal magistrate Benard Ochoi declined the request saying the application did not meet the threshold set to withdraw a criminal case.
Clifford Ochieng and Benjamin Onyango, Sonko’s co-accused, faced similar charges of possession of property for commission of a terror act.
The three pleaded not guilty to the charges, but the prosecution lead by Joseph Riungu and Harishon Kiarie opposed bail and bond.
The affidavit sworn by inspector Ezekiel Luley of the ATPU stated that the Ochieng and Onyango were arrested following intelligence reports that they had intentions to rescue Sonko from lawful custody.
