The lawsuit’s 14th Amendment claim of excessive force against four of the officers remained intact in a March 2023 ruling by Judge Gershwin Drain, who at that time dismissed an Eighth Amendment claim of cruel and unusual punishment and a “Monell” claim against the county for its policies and practices.
