MOBILE, Alabama Baldwin County Sheriff Huey “Hoss” Mack and a Baldwin County Sheriff’s deputy have been denied qualified immunity in a civil lawsuit filled by the mother of a Louisiana man who was shot following a single vehicle accident on Interstate 10 in 2017.
U.S. District Court Judge William Cassady, in an order filed April 19, dismissed a Monell liability claim against Mack stating that it was “inapplicable as a matter of law,” but denied the motion for summary judgement made by Mack and Deputy Matt Hunaday writing that “Without question, ‘the standard for excessive force is clearly established,’” against Hunaday, and that “plaintiff has made an adequate showing that this is the kind of recurring situation presenting an obvious, highly predictable potential for violation that can trigger liability for failure to train, even in the absence of a pattern of v
