We are honored to have as our lecturer john sexton of nyu, whose topic tonight is Warren Burger, Warren Burger is the founder of our society and of immense importance to us. There is no one more qualified than president sexton to deliver this lecture. He was a Warren Burger clerk, but he had a long history before that. It is worth a moment. President sexton earned his ba in history and his ma and phd in religion, and taught religion in brooklyn before he went to harvard law school. He went to harvard law school, graduating 1979 magna cum laude, and was the Supreme Court editor of the harvard law review. He then clerked for judge basil on and judge leventhal on the d. C. Circuit court before he clerked for chief Justice Burger. After his clerkship, he went to nyu in 1981, and by 1988, he was dean of the law school. His tenure there was extremely successful. Revolution . What kinds of changes did it initiate in american society, american law, American Government . Why should we think of the American Revolution as a revolution rather than simply a war for independence . So, we talked about weve talked about this in various frameworks. We talked about whether the revolution altered the social structure of the states that were involved in revolution. On the last time we met, we talked about the impact of the revolution on africanamericans and on the institution of slavery. We saw that in that case the legacy was quite mixed, right . The revolution set the institution of slavery on the path to destruction in the northern states but was instrumental in kind of deepening and strengthening the institution in the southern states. Today i want to talk about two topics that were closely interrelated and that are really two sides of the same coin. The main argument i was trying to make then focused on James Madisons role as the agenda maker for the philadelphia convention, and the particular argument i wanted to make is as madison prepares himself, i think the key item he worked on in his agenda is the idea that a system of federalism based upon the voluntary compliance of the states with the recommendations, the resolutions, the requisitions that came from the Continental Congress, was never going to work. When he reasons about this, he does so in a very interesting way. He combines a set of empirical observations about what took had taken place back in the 70s and lessons americans like him had learned since 1776. How washington functions. He takes a step back, and then what he does is to think abstractly, and what we can see a, at least implicitly, theoretic framework where he comes up with the idea that because states have different interests and different interests within each st
