gregg: a potential legal battle is brewing in san francisco, the city plans to open jailhouse doors and release illegal immigrants, busted for minor offenses before they can be picked up for deportation by federal authorities. the move is the latest in a battle between some cities in the federal government, a program to automatically check the immigration status of people picked up for minor offenses and, is san francicso really within its legal rights? is it headed to court? let s bring in our legal panel, doug burns and defense attorney joel mann. doug, let me start with you, the system automatically and electronically checks the immigration status of anybody who is busted, can san francisco do this and can the city ignore a program that is sanctioned by the federal government. it is a hot button issue, but
federal government can t force san francisco in doing this. it s an unfunded mandate. gregg: there is a clause. doug, congress passed a law, back in 1996, that makes even minor crimes grounds for deportation and, moreover, the same law specifically outlaws sanctuary cities. and i will put this on the screen here: the federal, state or local government and official may not pro sibt or restrict any government entity or official from sending to or receiving from the immigration and naturalization service, service information regarding the citizenship or immigration status, lawful or unlawful, of any individual a and prosecutions against sanctuary providers have been upheld in u.s. versus aguilar. should elected officials in san francisco be prosecuted? look, i agree with joel, i ll come out and say, crimes committed by so-called illegal aliens, those statistics are
