Andrew M. Cuomo (D) s handling of coronavirus cases in state nursing facilities. In a letter sent to New York Rep. Lee Zeldin (R-N.Y.) on Friday, Deputy Assistant Attorney General Joe Gaeta wrote that the Justice Department’s Civil Rights Division had requested information on “nursing facilities run by, or for, the State of New York” last August. After a review, the letter stated that the department would decline to open an investigation into any public nursing facility in the state based on violations of the Civil Rights of Institutionalized Persons Act.

ALBANY - The Justice Department said late Friday it will not open a civil rights investigation into New York s handling of COVID-19 deaths at state-run nursing homes.
The decision ends nearly a year of inquiry by the department started under then-President Donald Trump into how COVID deaths and infections swept through the vulnerable populations in nursing homes.
In a letter to some Republican members of Congress, the Justice Department said it has decided against opening a civil rights investigation into public nursing homes in New York, Pennsylvania and Michigan, but it still has a probe in two nursing homes in New Jersey.
In a letter sent to several Republicans who had demanded an investigation, Deputy Assistant Attorney General Joe Gaeta said civil rights division lawyers had reviewed the data sent by New York, along with additional information.
“Based on that review, we have decided not to open a CRIPA investigation of any public nursing facility within New York at this time,” Gaeta wrote, referring to the federal Civil Rights of Institutionalized Persons Act, which empowers the Justice Department to investigate allegations about unlawful conditions in government-run residences.
The Justice Department sent similar letters earlier in the week to officials in Pennsylvania and Michigan.
