Court Halts President Uhuru Kenyatta s Quest To Change Kenya s Constitution

NAIROBI, Kenya — A court on May 14 quashed an attempt by Kenya President Uhuru Muigai Kenyatta and opposition leader Raila Amollo Odinga to change the East African country’s constitution. In its ruling, a five-judge bench of the High Court said that Kenyatta acted illegally when he took the steering wheel to drive the Building Bridges Initiative to a United Kenya, the vehicle he was using to seek the constitutional changes. Kenyatta formed the initiative following his surprise March 9, 2018, “handshake” with Odinga on the steps of Harambee House, the President’s office in Nairobi. Odinga was Kenyatta’s primary challenger in the 2013 and 2017 presidential elections, marred by much violence between their supporters.

THE STANDARD NATIONAL Attorney-General Kihara Kariuki. [Jonah Onyango, Standard] Attorney-General Kihara Kariuki has filed an appeal challenging High Court’s judgement on Building Bridges Imitative (BBI).  Justice Kihara in his appeal, seeking to set aside the verdict by five High Court judges argues that they erred by declaring that President Uhuru Kenyatta can be sued in person. At the same time, he faults the court for finding that some sections of the Constitution cannot be amended. He accuses Justices Joel Ngugi, George Odunga, Teresiah Matheka, Jairus Ngaah and Chacha Mwita of bias and ignoring Kenya’s history on Constitution-making. According to Kihara, the verdict by the High Court is a recipe for chaos adding that they ignored the peace process that culminated in a push for Constitution amendment.
