Explainer: What is happening in today s joint session of Congress

Created: 06 January 2021 Today, at 1 pm EST, Vice-President Mike Pence will preside over the ceremonial counting of the electoral votes. It’s a process dating back to 1887 when Congress passed a law that detailed the way the ceremony should proceed. It is not a “certification” - that already happened a month ago when each state’s electors met and certified the vote count for their respective states. There are seven (and only seven) words that define what members of Congress can do today: And then the votes shall be counted.   The Electoral College votes are traditionally presented in two ornate, leather-lined boxes.

Judge Jeremy Kernodle, a President Donald Trump-appointed district judge in Tyler, rejected the suit on Friday, Jan. 1 declaring a lack of subject matter jurisdiction in his order of dismissal. The suit was then sent to the 5th Circuit Court of Appeals, which dismissed it in short order, providing only a single paragraph opinion on Saturday evening.

Gohmert, Arizona Electors Appeal to Supreme Court for Decision in Pence Lawsuit

Gohmert, Arizona Electors Appeal to Supreme Court for Decision in Pence Lawsuit Plaintiffs in a lawsuit against Vice President Mike Pence on Jan. 6 asked the Supreme Court to intervene after a district court and an appeals court rejected the case. Rep. Louie Gohmert (R-Texas), Arizona’s Republican electors, and other plaintiffs filed an emergency application, requesting intervention from Supreme Court Justice Samuel Alito, a President George W. Bush appointee. Plaintiffs asked the court to declare that Vice President Mike Pence has the “exclusive authority” to reject contested electoral votes in the joint session of Congress on Jan. 6. They argue that several sections of the Electoral Count Act are unconstitutional in constraining a vice president’s power to do so during such a session.
