Kim and Clark will have subpoena power in their investigation, which is expected to result in a written report.
Kim, who previously served as US attorney for the powerhouse Southern District of New York, is a partner at elite Wall Street firm Cleary Gottlieb Steen & Hamilton, where he focuses on white-collar criminal defense, internal investigations, regulatory enforcement, and crisis management.
Kim has spent the last 25 years bouncing between Cleary and the Southern District, where he has also served as chief counsel, chief of the criminal division, and deputy US attorney.
At Cleary, he represented Nissan in a US Securities and Exchange Commission investigation after its former chairman was accused of failing to disclose $80 million in compensation, and a hedge fund founder who pled guilty to federal bankruptcy fraud by trying to short-change creditors in the Neiman Marcus bankruptcy.
