In the legal analysis of the letter, it says: In the fraction of one second in within which time Granillo was forced to make a decision, it was reasonable for him to conclude that use of deadly force was justified. Haroldson also stated the final determination based on the deadly force of use review. Based upon the evidence made available to this office, including audio and video of the actual events, it is the determination of the Office of the Benton County District Attorney that there is not good reason to believe that a crime was committed by Officer Daniel Granillo in his use of deadly force, Haroldson said in the letter.

Guest Hans Bertel said Appelt attempted to break into his room. He tried all the rooms and then police said to drop the knife and all of a sudden I hear a boom, said Bertel. All of the involved officers in this shooting have been placed on administrative leave, which is standard protocol for CPD and consistent with statewide use of force protocol. Investigation into this incident is ongoing and is being led by the Albany Police Department (APD), with help from the Benton County major crimes unit. CPD said the department is committed to cooperating fully with the active case.
