The Court noted that since the school had not applied for regularisation, it did not have any legally enforceable right to seek the extension of recognition to continue functioning on the said grazing land.
Dr Abdul Bari Naik was in the news after he was booked on UAPA charges, although the former government college teacher had reportedly countered that he was being targeted for exposing corruption.
The order was passed while dealing with two PILs highlighting the stray dog menace in the Union Territory of Jammu and Kashmir and Union Territory of Ladakh.
"Substantive amendments could have been brought only by a competent legislature and not by the executive in exercise of power under Section 96 of the J&K Reorganisation Act," the Jammu court said.
