jon: the pent upon the s don t ask, don t tell policy is treading water for now, changing the law to allow openly gay women to participate in the armed forces, and that s raising the political stakes for the obama administration. mike emanuel live at the white house for us now. let s talk about, first of all, the dilemma for the president on this issue when it comes to enforcement, mike. reporter: well, jon, a lot of gay supporters of president obama thought he was going to be able to perform miracles, essentially, in the first couple of years doing away with don t ask, don t tell which does not, of course, allow openly gay people to serve in the military. the president s been clear he would like to overturn the policy, but he s got a dilemma in terms of waiting for either congress to act and they re obviously home campaigning now or waiting for the courts to act. so it is going through the court process. ultimately expected to go, probably, to the united states supreme court, bu

it would be better for the state if he cared about colorado or the consequences of having, as i say, the most liberal politician in the colorado and darn near, for all i know, throughout the west as the mayor i mean, as governor of the state. if he s really worried about colorado as he says he is, dan maes, that is, then he should, of course, get out. but it s getting to the point where it hardly matters now. if he got out, you know, there s only a week left to go. we re going to win this thing one way or the other, but it would certainly be a lot easier if we could just take one candidate into the race. jon: well, give us one example of what you think you would do differently in the governor s office versus john hickenlooper if he were to win. [laughter] oh, let s start with this. john hickenlooper s been running a sanctuary city in denver for seven years. people have died. i m telling you, people have died as a result of the fact that he has left this city open to illegal aliens
days ago. he s a foreign exchange student from afghanistan who s living in ohio. had wondered what had happened to him, but now indianapolis metro police are saying they think he may be a runaway which changes the look of things as they look for this kid. they re very hopeful he s going to turn up on his own. i m also watching that from the newsroom. back to jon and jenna now. jenna: thanks, harris. reporter: sure. jon: well, a fox news alert, and i m sure you ll be relieved to hear that lindsay lohan is not going back to jail. judge eldon s. fox has made jenna: you are so funny with this, you know? you just can t let it go. jon: i m so fascinated by lindsay lohan and what happens to her, and she is going back to rehab until january 3rd. by my count this is going to be her sixth trip to rehab since the drunk driving convictions and drug convictions that landed her in all this trouble. that started back in 2007. judge fox says it s back to rehab again for lindsay lohan.
