(CARMI) A White County Circuit Court judge has again ruled Illinois’ Firearm Owner Identification Card is unconstitutional, setting the stage for the Illinois Supreme Court to reexamine the issue. It was three years ago in 2018 that the same Circuit Court in Carmi sided with an elderly White County woman who had been charged with violating the FOID card law for owning a rifle without possessing a FOID card, finding the FOID card law was unconstitutional in the woman’s case. The state appealed directly to the State’s high court a few months later which led to no decision by the Illinois Supreme Court a year ago April in 2020, but calling the Circuit Court process into question. In yesterday’s ruling in Carmi, the Circuit Court dismissed the charges against Vivian Brown, saying the FOID card makes the Second Amendment a “facade” therefore turning the right to keep and bear arms in America instead into a privilege.
