A July hearing to determine the amount of losses incurred by four publicans, who won test actions over FBD’s failure to pay out on business disruption claims caused by Covid-19, must finish within the allotted two weeks, a High Court judge has said.
Mr Justice McDonald said on Wednesday it would not be possible to extend the hearing into August, due to a lack of judicial resources,
He also criticised “unhelpful” and “counterproductive” correspondence concerning legal costs issues between solicitors for two of the publicans in the case, Aberken and Hyper Trust, and FBD.

The operators of Dublin’s Leopardstown Inn have failed to get the High Court to dismiss an action against them arising out of a major water leak seven years ago outside the premises.
The leak, allegedly caused by damage to a main during a drilling operation for a water source, was estimated at the time to have caused the loss of one million litres of water a day for a fortnight before it was discovered in February 2014.

The High Court has ruled that four publicans who won significant test actions over FBD s failure to pay out on business disruption claims caused by Covid-19, are entitled to their legal costs, but not on the highest scale.
In his judgement Mr Justice Denis McDonald said that while it was accepted that the actions were important test actions.
He said that the court, after considering various legal authorities on the issue could see no proper basis to order that the costs should be assessed on the legal practioner and client basis- the highest level of costs that can be awarded.
