see a possible indictment. and with a case so sprawling when might a trial begin? yeah, a target letter is an indication jack smith is nearing the end of an investigation, so we could literally see within a matter of days or weeks an indictment returned by the grand jury in washington, d.c. and, you know, interestingly even though the mar-a-lago documents, obstruction, and espionage case was indicted first, there is no first in, first out. first indicted, first at trial rule. so it could very well be that we see a washington, d.c. trial if this case is indicted before we ever see a trial down in florida, but it s a little bit of an open question. i would suspect we would begin to see trial some time early 2024. we certainly appreciate your analysis this morning, nbc news and msnbc legal analyst, glenn kirschner. come back soon. thank you for being on today. now, let s turn to another
major legal blow for donald trump, this time in his hush money criminal case involving stormy daniels. a judge denied the former president s request to move the manhattan case against him from new york state court to federal kwourt. trump argued the alleged hush money payments were connected to his duties as president. the judge didn t buy it, instead ruling that trump s lawyers failed to meet the legal requirements for changing venues. in a 25-page opinion the judge wrote trump, quote, failed to show that the conduct charged by the intitle is for or relating to any act performed by or for the president under color of the official acts of a president. the evidence overwhelmingly suggests that the matter was purely a personal item of the president, a cover-up of an embarrassing event. the house spokesperson for manhattan d.a. alvin bragg issued this statement following the ruling saying, we are very pleased with the federal court s
mccarthy who was asked about comments he made shortly after the january 6th insurrection. at that time he said that trump was responsible for the riot. after january 6th you said donald trump bears some responsibility for the attack on the capitol. if he s found criminally responsible will you respect the results i don t see how he s found criminally responsible. what criminal activity did he do? he told people to be peaceful. that s one of the gop talking points we re hearing a lot these days. meanwhile, the former president may have already laid out his defense in this potential case. in a long and rambling social media post on tuesday in which he announced that target letter from jack smith, trump wrote this i have the right to protest an election i am fully convinced was rigged and stolen. a former federal prosecutor tells nbc news that trump s
when they viewed as damning and the skeptical response they say they received from the prosecutors involved. i m here to tell you that the delaware u.s. attorney s office and the department of justice handling the hunter biden tax investigation was very different than any other case in my 14 years at the irs. at every stage decisions were made that benefitted the subject of this investigation. reporter: but democrats on the panel were quick to push back pointing out it s the job of prosecutors to make the call to hand down indictments, not investigators. i mean and so the prosecutors are the ones that make the decision. reporter: shaply also testified david weiss, the federal prosecutor in delaware who handled the investigation, said he didn t have the authority to decide whether the charges were filed. the story has been changing from the department of justice and u.s. attorney weiss. reporter: weiss, a trump appointee, has sent multiple letters to congress disputing that.
