The answer, says attorney Corey Hogan is, probably yes. Hogan’s law firm, Hogan Willig, has challenged a number of state and local government mandates during the pandemic. And the firm is already at work on new filings. This comes after twin announcements Wednesday by Erie County Executive Mark Poloncarz and Governor Mark Poloncarz. Poloncarz said he expected to issue a mask mandate to county employees based on the recent, rapid rise in COVID cases. The so-called delta variant of the coronavirus has been cited as the strain causing most of these cases.

A lawsuit could be filed against New York State over a policy requiring children, including those as young as two years old, to wear a face mask while at daycare or summer camp.  The guidance, which is in line with the Centers for Disease Control and Prevention, indicates children two years old and up need to wear masks in daycare centers unless they’re doing things such as eating, drinking, swimming, or sleeping.

Andrew Cuomo’s pandemic shutdowns.  Attorney Steven Cohen of the firm HoganWillig represents Western New York restaurant owners in their quest to welcome back dine-in guests. He believes not only is the governor overstepping his bounds, but so are varying state agencies.  “Such things as, they didn t have two sides of the tent open wide enough. Or the diners, the people who came in to dine, didn t finish their food by 10 p.m.,” said Cohen. “These are things that are ordinarily out of the purview of the State Liquor Authority. But all of a sudden, the governor is enforcing his edicts by using all of the tools at his disposal.”
