The High Court of Jammu and Kashmir and Ladakh recently quashed a preventive detention order passed against a man while observing that stale incidents cannot be the basis of such detention
The petitioners placed reliance on a judgment of the Supreme Court which held that the High Court must ascertain whether any part of the cause of action arose in jurisdiction.
The Court said that the amended clause(e) of Section 10(2) of the Motor Vehicles Act had replaced all types of commercial vehicles with 'transport vehicles', which includes goods vehicles and passenger-carrying vehicles.
In a major reshuffle, the High Court of Jammu and Kashmir and Ladakh on Wednesday ordered transfers and posting of 76 judicial officers across the Union Territories of Jammu & Kashmir and Ladakh.
