The future of a planned cell tower on Dolgeville Volunteer Fire Department property at 20 S. Helmer Ave. is currently in the hands of the court.
And residents opposed to the placement of the tower on the site are meeting regularly and are posting signs in the village expressing their concerns.
The Dolgeville Zoning Board of Appeals voted last November to grant a use variance that would allow the project to move forward, but early in December a resident filed an Article 78 proceeding in Herkimer County Supreme Court asking that the ZBA’s decision be set aside.
Penny Primeau, through attorney Claudia K. Braymer, of Braymer Law, of Glens Falls, filed the action against the Dolgeville Zoning Board of Appeals, New Cingular Wireless PCS, LLC (AT&T) and the Dolgeville Volunteer Fire Department Dec. 2, 2020, in Herkimer County Supreme Court.
