A defense attorney for the Idaho author accused of working to keep the remains of his wife’s children hidden is seeking to question a journalist from an online publication that has covered the case closely.

The subpoena from Chad Daybell s defense team aims to have Nate Eaton, news director at EastIdahoNews.com, testify as a witness. Daybell s attorneys are arguing that a trial should take place in a different, more densely populated part of the state because of the publicity it s garnered.

IDAHO FALLS New court documents filed in the Chad and Lori Daybell case identify witnesses whom Chad’s attorney, John Prior, plans to call in an upcoming hearing.
EastIdahoNews.com reporter Nate Eaton appears on that list as a “lay witness.” He was subpoenaed late Tuesday afternoon while at work and ordered to be present at the hearing on June 9. A subpoena is a court-ordered command for a person to appear in court as a witness or for someone to provide evidence that will be used in a legal case.
Lori Vallowâs attorney Mark Means and special prosecutor Rob Wood met behind closed doors on Dec. 18 at the Fremont County Courthouse with Seventh District Judge Steven Boyce for a hearing on a motion to remove Wood from the Vallow case. Boyce heard arguments concerning allegations of misconduct regarding Wood.
Boyce set a second hearing for Jan. 6 at which time he will make a decision regarding the motion to remove Wood. Newly released documents reveal what happened at the closed hearing.
Means and Chad Daybellâs attorney John Prior filed a joint motion to disqualify Wood from the case.
In court documents filed Dec. 15, Means said he recently received an audio recording that proves Wood had committed âprosecutorial misconductâ in an interview Wood had with Vallowâs relatives in October in Arizona. At that time Wood met with Vallowâs sister Summer Shiflet and former sister-in-law Zulema Pastenes. Pastenes was married to Vallowâs brother, Alex Cox
