they still have five decisions to release with most court watchers wondering if the opinion on marriage equality will be made public today. we were surprised to get the health care subsidy ruling thursday. what are you hearing? there is tremendous anticipation here. we are just really moments away from the court beginning to at least issue some decisions today. we don t know which ones. five left. marriage equality on everyone s mind. a few feet from me there are massive amounts of protesters and activists excited thinking maybe today will be the day. other big decisions on the docket. lethal injection, highly controversial debate over how inmates are killed through drugs. and a big redistricting case. symbolism of june 26th he would it comes to lgbt rights in the country.
perhaps through some kind of health care subsidy so there isn t a large gap in their coverage, but again that would play into the narrative that the republicans are using about governmental overreach. interesting. i want to bring up the subject of activist judges with jeffrey toobin because you know you are going to be hearing a lot about that today. activist is always in the eye of the beholders. liberal love it when the court strike down laws like the defense of marriage act and say that congress overstepped its bounds. conservatives love it when they strike down laws like this part of obamacare or the voting rights act as they did last year. so everybody likes or dislikes activism depending on the result they get. here, the conservatives liked an activist court that struck down the democratically elected branches of government, the president s interpretation of the obamacare law.
care health care costs down but. jenna: so right now the number looks about 80% of those enroll having some sort of government subsy did i which is roughly what the cbo and government estimated it will be. right. jenna: broadly speaking, we re going one year from where folks were not getting government subsidies, maybe they were, we don t know who they really are to those enrolled with health care subsidies? jenna, the thing we have to remember, most of us have a government subsidy for our health care spending. everyone works for a big company when, the big company helps to cover our health care costs they re getting a tax subsidy for that. a lot of people, already have tax subsidies and they re transferred to more direct payments. the big issue obamacare doesn t address is the health care tax, this health care subsidy embedded in our tax code. and that is one of the criticisms of the law that we re
this is going to be a big hit to economic growth and productivity over time. what did they find? explain that, summarize what they found. right. because the subsidies, obamacare subsidies fade out as cash income rises, it gives people incentive to stay poor and say i m not going to work as many hours, i m not going to accept a promotion. i m not going to go after a different job because i want to keep getting those subsidies. this is sometimes called by economists the subsidy cliff. if you make an additional dollar of income, your subsidy falls dramatically or goes away. you have to make that calculation when deciding should i take that better job? should i take that promotion if it means i m losing high health care subsidy. right. this is the marginal tax rate on additional dollar of income. the implicit marge aa aal tax r.
to live off the sweat and work of other people. is that the american way? that sounds odd to me. and mara, america is seen around the world as a place of opportunity, and maybe people don t think of opportunity in these terms, the opportunity to not work. you know, it s different than the fabric of what a lot of people think our country is. i can tell you that this whole debate over the cbo report, affordable care act, has been a terrible, terrible conversation for the white house and for democrats because we have now gotten into down the rabbit hole of whether this is going to encourage people to not work. i don t think the health care subsidy is enough for people to live on, so they re not going to work. it just helps them buy health insurance. it s not a guaranteed income, not like we re giving a check to somebody. but it makes more sense when they do all the calculations, more sense for them financially to stay home. they could be somebody older. they could be a mother who
