a slam dunk hazing case under missouri law. there s countless hours of real-time surveillance video, which you almost never have in a hazing case but we have it here. there s a 144-page police report. everything the prosecutors need are there. read the hazing statute. every officer that participated in this is guilty under hazing. after eight months, they re refusing to bring charges and nobody can understand. martha: you make a great point. the video that you re looking at is surveillance video, which i believe this fraternity knew these cameras were active in this building, right, david? that s correct. who in their right mind would do this to somebody with surveillance cameras rolling? they have no fear of being caught. they know that some of the supporters of the fraternity and other entities and the prosecutor s office are not willing to purchase stew the

has a very strict hazing statute. it s, we have felony hazing. and you know, considering the complexity of the case, they ve decided to go after felony hazing. because they have to prove two things, they ve got to prove there was a death and robert champion is dead and they ve got to prove that there was hazing involved. i think that they don t think they re going to have a hard time proving those two things. robert champion died back in november. here we are in may. what s taking so long to bring justice here? well, it s like i said, it s a complex case, a lot of the experts and scholars that we talked to are telling us that you know, i ve got a bus full of people on that night on november 19th. you ve got you know, by some accounts, more than 20 people. students and alumni who may or may not have participated in some way, so it s going to take a long time to figure out not only the details of what happened that night, but who did what, and then try to find out
11 participants, that s one of them with hazing. in convicted the maximum anyone could face would be six years in prison. again, the question is why not murder or manslaughter charges? one answer says state prosecutors is that it would be tough getting convictions with the evidence that they have. the testimony obtained to date does not support a charge of murder in that it does not contain the elements of murder. we can prove participation in hazing and a death. we do not have a blow or a shot or a knife thrust that killed mr. champion. it is an aggregation of things which exactly fit the florida statute as written by the legislature. well, that statute was written seven years ago with the best intentions to hold people accountable for hazing deaths. you have to wonder, though, does the very fact that it s on the books allow some people to pay lighter penalties for causing someone s death than would otherwise be the case? the attorney for the champion family says so. he
