BREAKING : Kerala High Court Quashes Kerala Police FIRs Against Enforcement Directorate

Share This - x The Kerala High Court on Friday quashed the two FIRs registered by the Kerala Police Crime Branch against unnamed officials of the Enforcement Directorate for allegedly coercing the accused in the gold smuggling case to give false incriminating statements implicate Chief Minister Pinarayi Vijayan and other state functionaries. In a judgment pronounced on Friday, the High Court held that the bar under Section 195(1)(b) of the CrPC was attracted in the case against the FIRs. As per Section 195(1)(b) CrPC, the cognizance of an offecne relating to fabrication of evidence in a matter pending before court can be taken only on the basis of a complaint filed by that Court.

Share This - x The Kerala High Court today closed hearings of the writ petitions moved by the Enforcement Directorate challenging FIRs lodged against its officials by the Kerala Police. Expressing that the hearing had been a pleasure, Justice VG Arun informed the counsel that he would try to pronounce judgment by April 16, if possible, inspite of the Court being on vacation. The petitions filed by P Radhakrishnan, Deputy Director of ED (Kochi Zone) challenge FIRs lodged against officials of the ED for allegedly coercing gold smuggling accused Swapna Suresh and Sandeep Nair to make false statements against the Chief Minister and other State Ministers.

Share This - x The Kerala High Court today extended its interim order restraining coercive action against officials of the Enforcement Directorate (ED) in the cases lodged against the agency by the Kerala Police. The writ petitions against FIRs registered by the Kerala Police were taken up before a Bench of Justice VG Arun today, saw submissions by Senior Advocate Harin Raval on behalf of the Kerala Police. The petitions filed by P Radhakrishnan, Deputy Director of ED (Kochi Zone) challenge FIRs lodged against officials of the ED for allegedly coercing gold smuggling accused Swapna Suresh and Sandeep Nair to make false statements against the Chief Minister and other State Ministers.
