The Delhi High Court yesterday denied prayer of a murder-accused for interim bail to pursue regular PhD classes, noting the gravity of the stated offence and allegations that the complainant had.
While considering gravity of the offence as a factor for determining grant of bail, the court does not have to adjudicate on the elements of the crime and find out its extent, the Bench held.
The Supreme Court on Tuesday questioned the parole which was granted to convicts in the Bilkis Bano case during incarceration saying the gravity of the offence should have been considered by the Gujarat government.
Even in cases involving economic offences where there is strong prima facie evidence against the accused, it cannot be said that bail should invariably be refused, the Court added.
