Within hours of pledging to “preserve, protect, and defend the Constitution,” President Joe Biden unveiled a radical regulatory agenda that will undermine fundamental constitutional principles and decades of rulemaking precedent. The run of memoranda and executive orders also dismantles a host of much-needed restraints on the regulatory state instituted by the Trump Administration.
Of particular concern is President Biden’s memorandum on Modernizing Regulatory Review,REF which loosens standards of cost–benefit analysis in rulemaking. The President boasted that the actions provide regulators with the “flexibility” to undertake “robust regulatory action.”REF That is the worst course possible at any time but particularly now, when regulatory escalation will inhibit the nation’s economic recovery from the COVID-19 lockdown.
