The Supreme Court rejected Maharashtra government s request for a stay on the acquittal of G N Saibaba and others in the Maoist links case. The court admitted the government s appeal against the well-reasoned Bombay High Court order by BHC. Saibaba was wheelchair-bound and lodged in Nagpur Central Jail since his arrest in 2014.
The former judge also said that district courts many times refrain from granting bail in criminal cases as they are under constant pressure due to the supervisory jurisdiction of High Courts.
Last year, Justice Rohit B Deo passed an order acquitting Delhi University professor G N Saibaba who was sentenced to life imprisonment for alleged Maoist links. He also recently stayed a GR pertaining to illegal excavation by contractors of the Samruddhi Expressway.
