Trade Court Backs Denial Of Duties On Plastic Resin Imports

ADVERTISEMENT Trade Court Backs Denial Of Duties On Plastic Resin Imports Law360 (May 6, 2021, 6:00 PM EDT) Plastic resin imports from five countries escaped anti-dumping duties sought by domestic producers when a federal trade court backed the U.S. International Trade Commission s findings that a domestic supply shortage, and not low prices, caused the surge in imports. After unearthing conflicting evidence in a similar determination the commission made last year, U.S. Court of International Trade Judge Gary Katzmann upheld the commission s revised finding that PET resin, a polymer used to make plastic bottles, wasn t being sold at unfairly low prices.

Federal Court Upholds Trump Tariffs On Steel Imports

February 04, 2021 7:08 PM ET Font Size: A U.S. Court of International Trade ruling Thursday upheld the “Section 232” national security tariffs on steel imports that were imposed by the Trump administration in 2018. A panel of three judges at the Court of International Trade a federal court with jurisdiction over trade law disputes rejected a legal challenge from steel importer Universal Steel Products that argued former President Donald Trump lacked the authority to impose the tariffs and the legal process used was “procedurally deficient.” The court concluded in Thursday’s ruling that the Trump administration appropriately applied Section 232 of the 1963 Trade Expansion Act, which allows the president to set import restrictions on the basis of national security.

Judge Extends Order Halting Trump Administration s Bifacial Solar Tariffs

The U.S. Court of International Trade on Friday extended a temporary block on the Trump administration’s bid to expand Section 201 tariffs to include two-sided solar panels. The extension means imported bifacial solar panels can continue to enter the United States tariff-free, despite numerous attempts by the Trump administration to charge duties on those products. The latest intrigue in the back-and-forth on Section 201 tariffs concerns a presidential proclamation released in October. That proclamation extended Section 201 tariffs to bifacial solar products and increased the level of the tariffs from 15 to 18 percent in their final year while also opening the door to a possible tariff extension.
