The Court said there was no evidence to allow proceedings to continue against Virupakshappa and he cannot be prosecuted only because he is the father of co-accused Prashanth Madal.
The former MLA further said that when the Rajput community picks up arms no one would dare to raise the threat of `Sar Tan Se Juda` and create terrorism.
