　　集微网报道 16世纪至19世纪，欧洲列强为了争夺海上霸权，向私人船主发放私掠许可证，允许其携带武装劫掠敌国的商船，一大批受到国家支持的“合法”海盗由此诞生，这就是大航海时代赫赫有名的私掠制度。然而到了21世纪的今天，“私掠”这一早已湮没在历史尘埃中的财富汲取手段，却又在专利领域出现。　　专利私掠一般表现为，有着大量专利积累的专利巨头通过设立子公司、换壳、交易等手段，将专利分散至多家NPE（非实施实体）手中，并参与NPE高额许可收入分成。特别是诺基亚等退出智能终端业务的专利权人，近年来在专利许可中的激进作为颇受诟病。2013年，谷歌在一份与黑莓、Earthlink、红帽（Red Hat）的联名信中暗示，微软、诺基亚存在专利私掠行为。2016年，苹果控告9家NPE与诺基亚合谋通过专利授权创造及勒索更多收入。 �
