convicted of murder in the second degree. now u.s. district court judge in san francisco has ruled she has a medical condition where your sex at birth conflicts with the gender you identify with. the judge stating she has established she is suffering and likely to continue to suffer unnecessary pain if she is denied the surgery. ruling that members of the lgbt community are now applauding. this decision is historic in that it confirms that it s unlawful to deny central treatment to transgender people. reporter: some legal scholars say even if you disagree with this, the judge s ruling upholds the eighth amendment. if there is a serious medical need and the government shows deliberate indifference to that need it violates his eighth amendment right against cruel and inhumane treatment.
