Cuomo Suffers Defeat as Court Rules Against Restaurant Restrictions; Health Department Lifts Ban on Indoor Dining

Governor Andrew Cuomo and NYS suffered a stunning defeat in Erie County Supreme Court on Wednesday, January 13th, 2021, as Judge Henry Nowak decided that the restrictions on indoor dining are inappropriate and that indoor dining can reopen under yellow zone restrictions.
The following day, On Thursday, January 14th, 2021, the Erie County Health Department says that based on preliminary injunction issued by NYS Supreme Court it will apply “yellow zone” criteria to ALL restaurants in “orange zones.” This means all restaurants in Erie County will be able to offer indoor dining at 50% capacity.
