Emergency ruling, called a shadow docket decision. the court is using that often to weigh in on major cases. here to explain, amy howe. explain this to me. how does a shadow docket decision differ from a typical supreme court decision and why is it a big deal that the supreme court is using it more? so, when we think about the supreme court, we think about the decisions on the merits, like on obamacare or the president s tax returns. in those cases the supreme court gets multiple rounds of briefing, including from people who may not be involved in the case but may have unique perspective, they hear oral argument in open court and months later issue opinions that sometimes in the case of the president s tax returns, for example, might be 70 pages long. and about 70 of those cases every year. everything else is what we call the shadow docket. what we talk about with the shadow docket are emergency
