A spokesperson for the Denver District Attorney's Office says it doesn't believe it can prove guilt beyond a reasonable doubt in the Feb. 5 shooting, an ethical standard it must meet in order to file charges. Police have said the owner of the stolen car used an app to track and find his vehicle and, when he approached it, there was an "exchange of gunfire."
A Dever man who fatally shot a 12-year-old boy in a stolen car during a shootout won't be charged. The DA's office believes it does not meet the ethical standard to charge the man.
Elias Armstrong has been identified by the Denver Office of the Medical Examiner as the 12-year-old boy who was shot and killed by the owner of the alleged stolen vehicle.
