The lawsuit said Alameda police officers failed to de-escalate the situation and knew Mario Gonzalez did not pose any danger and didn’t make any “threatening action toward any of the officers.”
The suit claims that Mario Gonzalez was the victim of excessive force and that his arrest, and therefore, death, was unconstitutional. In their suit they argued that there was no reason to arrest the 26-year-old in the first place, let alone pile on top of him to put him in handcuffs.
