It is part of an ongoing fallout for his decision to sentence former stanford swimmer brock turner to six months in jail for Sexual Assaulting a woman who had passed out drunk in a Campus Fraternity party last year. Judge persky has faced backlash including calls for his removal or recalled. The d. A. s office says in this case a male nurse is accused of Sexual Assaulting a woman while knocked out during a medical procedure. Kpix 5 legal analyst Ladoris Cordell says it comes down to a question of whether or not the judge can be fair and impartial. They did not believe that he could be fair. And by fair meaning i think not in the presiding over the trial itself but if there were a conviction, they dont believe that office does not believe that he would be fair in the sentencing based upon what happened in the turner case.
