The homeowners allege that the city and park district were negligent in installing storm barriers that an April 2020 storm overcame. Shoved aside by a wave surge, the barriers crashed into the condos’ own storm protection and “obliterated” it, according to the complaint.
Since then, “uncontained waters from Lake Michigan have entered the condos, causing damage,” the lawsuit says. It does not specify the amount of damage to condos.
Howard Teplinsky, a lawyer with Loop law firm Levin Ginsburg who represents the association, declined to comment or put Crain’s in touch with condo owners. The city’s law department and the park district declined to provide anyone for comment.

ELKHART, Ind. An Elkhart woman who has lived through two pandemics is now fully vaccinated against COVID-19.
Nellie Yoder received her second dose of the COVID-19 vaccine this week at her assisted living facility. She told WNDU-TV getting the shot was important. Whatever they say, if it takes two shots or three, I will take them, Yoder said.
Still, she never thought she d be getting vaccinated next to Elkhart Mayor Rod Roberson and with all of her friends lined up to be fully vaccinated with her.
