it s a new chapter in this ongoing story of presidential power. no president has ever used an emergency power to, an end run around congress. there s been dozens of emergency power declarations. zero of them look like this. where a president went to congress and said i d like you to fund this congress. congress said no, we re not giving you u money for this or this much and he says tough, i m going to use emergency power to do it any way. we ve never seen a fight in the courts about whether an emergency truly exists and the question about whether the court will rule that congress gave him this authority in the emergency power statute about military construction. it will be extremely interesting to watch. the only thing that s been missing is that remember, there were two other parts of money the white house said they were going to use for this that did
not involve emergency power including redirecting a lot of military funds into the military s counternarcotics budget and using that to launder the money out into the wall. it s going to be a big fight to see what other programs in the pentagon get zeroed out to sif than money out and what the appripriations committees on the hill say about what. that fight could come up before we get to the emergency power resolution in the courts. the president did spend a lot of time talk iing about the military yesterday. he spent a lot of time talking about a whole lot of things. he did mention i didn t need to do this. eleanor, you think he s going to regret saying that. i think the lawyers arguing this case that they re going to point to that immediate ly. and as charlie pointed out, some o the pot of money they re going after, he didn t need the morni emergency resolution to do that. i think the president has already undermined h his own
