potentially even bring threats upon them. don t forget, what the leader of our senate said about three years ago, directly in front of the court to justices kavanaugh and gain of function research. he said you have released the whirlwind. he said you will pay the price. you won t know what hit you this was the head of our senate. brian: schumer. violence toward the court. and so the current president doesn t miss an opportunity january 6th and talk about how he supports the institutions of our democracy. but we have critical institution that is being harassed right now. and it would be good to see this administration show more concern, take more action to enable that court to function the way it needs to. ainsley: i m sure your dad would have been appalled when he seen the reaction and all of the protests in front of the justices homes. alito did tell the wall street journal that he is admission the fact it was a justice. he doesn t think it was one of the justices.
troubled by the ongoing harassment of the justices. steve: eugene, you know, there has been speculation, maybe it was actually one of the justices who did it, could be a conservative justice, could have been a progressive justice, and ultimately, that would be highly embarrassing for the court. and that s why they had the marshals do it and not calling the fbi. i mean, a lot of from what i have read and you probably know better than anybody, a lot of it was kind of the honor system. they just called people in and said hey, do you do this? and that was it. well, look, i don t blame the supreme court for not wanting to call in president biden s fbi to rummage through its papers and interview its personnel. they weren t going to do it. i also, i have to tell you, i don t believe that it would have been one of the justices. i think that all of the justices we have are hardworking well-meaning people who respect that institution. i think it s most likely was a clerk who was seeking to
opinions, his memoranda to the justices. and those are still not publicly available. draft opinions from decades ago. and that s pursuant to confidentiality that would have been important to him and that was important to the current members of the court. i will never forget justice kennedy who was still on the court at the time when i mentioned to him that i was trying to determine what restrictions to put in the papers, justice kennedy, who is just a little taller than i am leaned in and said to me, you know, gene, your father s papers are my papers, too. what he meant by that was, he didn t want his memos to my father, his draft opinions being out there in the public realm even years later because that was a threat to the functioning of the court. so just imagine how they viewed the release of a current draft and a current case. as affecting the court. and ultimately, affecting the country, too. because how important it is that the court function well and justice alito was obviously
