New E.O. Revokes TikTok and WeChat Prohibitions, But Lays Framework for New Restrictions | Kelley Drye & Warren LLP

To embed, copy and paste the code into your website or blog: Yesterday, President Biden signed an Executive Order (“E.O.”) that formally revokes and replaces three earlier E.O.s that aimed to restrict transactions with TikTok, WeChat, and other communications and Fintech applications and provides a new framework to address security concerns related to the information and communications technology and services (“ICTS”) supply chain.  The new E.O. was issued pursuant to the ongoing national emergency declared in the 2019 E.O. 13873 regarding ICTS in the United States that are controlled by persons within the jurisdiction of a “foreign adversary,” including China.

It’s expected to be delivered by June 25th and should, if the Pentagon complies with the Senate’s instructions, provide a current assessment of what our military and the federal government either know or suspect about the unidentified vehicles that have been flitting around our restricted airspace for quite some time now. The idea that the unclassified version of the report will contain astounding, earth-shattering information isn’t held by many serious observers, and some have suggested that the report may not be delivered at all. ICYMI: President Trump Recently Greenlit Durham's Use of Classified Information

  Share Source: (AP Photo/Bob Child, File) President Donald Trump recently authorized Special Counsel John Durham to use a plethora of classified information as he continues his criminal investigation into the origins of the FBI s Russia probe.  The Attorney General is currently conducting a review of intelligence activities relating to the campaigns in the 2016 Presidential election and certain related matters.  On May 13, 2019, the Attorney General directed John Durham to conduct that review, which subsequently developed into a criminal investigation.  On October 19, 2020, the Attorney General appointed Mr. Durham to conduct that investigation pursuant to the powers and independence afforded by the Special Counsel regulations of the Department of Justice, President Trump wrote in a memo late last week.
