The prosecution says he smothered with the child to get rid of him because he was interfering with a relationship with his 17yearold girlfriend. They clearly had doubts about the case and dj creato maintains his innocence saying the child wandered away from home. No evidence, i believe they couldnt prove their case beyond. I think the nature of a hung jury is that they cannot find guilt beyond a reasonable doubt. Now prosecutions could retry the case, the judge set a date of of july 5th if they want to do that for a status hearing and his client will remain in custody until the judge lowers his 750,000 bail and he will make a motion to do that immediately.
