Mar 5, 2021 Mistrial in Patrick Harris Murder Case Justice Herbert Lord today ruled a mistrial in the case of Patrick Harris. When the case began last week Tuesday, Justice Lord decided to enter into a voir dire during the trial to determine whether a group identification that the police conducted in 2017 was lawful.  The judge ruled it was not and proceeded with the trial.  But on Thursday morning, the crown’s main witness attempted to do a dock identification of the accused.  The defense attorney again raised arguments over features that he felt ought to have occurred to allow for this.  The case was adjourned for lunch, but not before the judge told the witness to not speak to anyone during the break regarding the matter.   That was when Selgado said he saw the same witness speaking to a police officer, who then escorted him to the D.P.P.’s office.  Selgado submitted that while it was possible that the witness and the prosecutor did not speak about the ma

Mar 1, 2021 Murder Trial for Patrick Harris Resumes on Thursday The murder trial of Patrick Harris will proceed on Thursday in the Belize City Supreme Court after Justice Herbert Lord ruled today that the submissions made during a voir dire were not strong enough to throw the matter out.  Harris’ attorney, Oscar Selgado had made several submissions last week over whether the court should allow the identification procedure that the police applied in its evidence gathering against Harris.  Selgado’s arguments raised last week included that his client had refused to be included in an identification parade and that his identification was made without his consent.  But the prosecution, headed by Crown Counsel Portia Ferguson, argued that the police have a right as well to carry out a group identification, which is done differently from an I.D. parade.  The crown was able to convince the court that it carried out the identification by legitimate standards. The case wil

Feb 26, 2021 Patrick Harris Justice Herbert Lord is expected to make a ruling on Monday in a voir dire that preceded the actual murder trial of Patrick Harris. Justice Lord decided this week to enter the voir dire (a hearing within the actual trial) to determine whether or not Crown Counsel, Portia Ferguson, will be allowed to enter as part of the prosecution’s evidence, the identification of Harris in the actual trial. Harris’ defense attorney, Oscar Selgado objected to allowing the identification of his client as evidence in the actual trial because the identification was done without his consent. Under Belize’s Law, an accused has the right to object to any kind of identification, but the Police have the right to still do an identification covertly.  In this case, the identification was carried out in a group setting.
