MARLBORO â Seth Andrew, who is out on a $500,000 bond on charges of money laundering, is asking a federal judge for permission to move from Marlboro to Rhode Island.
According to documents filed in the federal court of the Southern District of New York, Andrewâs attorneys have requested a modification of the bail conditions imposed by the court on April 27. Andrew is co-founder of Democracy Builders, which bought the campus of Marlboro College last year.
âUnder the terms of his release, Mr. Andrew must remain within the District of Vermont, where he currently resides, except for attorney visits and court appearances,â wrote Edward Y. Kim, of Krieger Kim & Lewin, in the modification request. âMr. Andrew, who has been fully compliant with the terms of his release, intends to relocate his family to a home in Rhode Island and anticipates that such a move will require several trips between Vermont and Rhode
The statement, addressed to Seth Andrew, then DBF s CEO, in Marlboro, lists a SBA Cares Act PPP Grant (Unrealized) in the amount of $943,365 as a current asset as of December 31, 2020.
As a liability, the statement also lists a slightly larger amount – apparently the PPP loan total plus a small amount of interest. The former figure represents what DBF will receive if its application to SBA for forgiveness of the loan receives the agency s approval: The loan would then become a grant.
Documentation obtained by VBM appears to indicate that DBF applied for the forgiveness in April. The status of that application is uncertain. Accessed on May 20, federalpay.org reports that the loan, issued through JP Morgan Chase Bank, has been disbursed by the lender and has not yet been fully repaid or forgiven. The SBA database provides no information on the question.

MARLBORO â The chairman of the board of the Marlboro School of Music, which for more than 70 years has hosted the Marlboro Music Festival on Potash Hill, is asking a local judge to establish an escrow account to hold its lease payments until ownership of the former Marlboro College campus can be established.
â[Democracy Builders Fund] has advised me that it believes it is the current owner of the Campus, and Type 1 [Civilization Academy Marlboro Campus LLC] has advised me that it does not recognize DBF as the current owner of the Campus,â wrote Christopher Serkin in documents filed with Windham Superior Court on May 12.

On April 27, the US Attorney s Office for the Southern District of New York filed a criminal complaint against Seth Andrew, the motivating force behind Democracy Builders Fund, which purchased the campus of the defunct Marlboro College last July. On April 30, Degrees of Freedom, an innovative but non-accredited educational institution and a DBF project, announced it was delaying launch of its operations on the 533-acre campus.
